Rumsfeld Sued Over Torture

A lawsuit alleging that Defense Secretary Donald Rumsfeld is responsible for the prison torture scandal in Afghanistan and Iraq moved to federal court Wednesday against the wishes of government lawyers representing the Pentagon chief.

The lawsuit was filed by the American Civil Liberties Union and Human Rights First on behalf of eight Afghani and Iraqi men who say they were tortured while held in U.S. prisons in Iraq and Afghanistan.

A panel of seven judges -- the Judicial Panel on Multidistrict Litigation -- moved the lawsuit to the U.S. District Court for the District of Columbia, consolidating pretrial proceedings of four lawsuits filed by the ACLU. The other lawsuits were filed against Lt. Gen. Ricardo Sanchez, who commanded U.S. forces in Iraq when the alleged abuse occurred, Brig. Gen. Janis Karpinsky, who commanded U.S. military police forces in Iraq at the time and Col. Thomas Pappas, who commanded U.S. military intelligence and military police forces in Iraq at the time.

According to the ACLU, lawyers representing the military commanders wanted the case tried in the Eastern District of Virginia, rather than elevating the case to the federal level.

"This brings us one step closer to proving in court that the legal responsibility for the systemic abuse and torture of detainees in U.S. custody in Iraq and Afghanistan lies at the top of the chain of command and not at the bottom," said a statement from Lucas Guttentag, the lawsuit's lead counsel and director of the ACLU's Immigrant's Rights Project.

Chief Judge Thomas F. Hogan will hear the case.

"We welcome this decision and hope that we are closer to having a federal court reverse policy decisions that have led to torture and abuse," said Michael Posner, executive director of Human Rights First in the statement.

Calls to the Justice Department for comment were not returned in time for publication.

Maybe a counter-suit needs filed against the Clintonistas for decimating out intelligence community that allowed most of this to happen in the first place.

Congress needs to get it's collective arse in gear and exercise it's right to limit jurisdiction. The Civil courts have no authority here especially where it involves policy and not the law..

Wasn't there a law at one time that the Military could not be sued in a civil action?
It seems to me that unless there is evidence of direct orders from Rummy endorsing abuse, this is a frivolous lawsuit.
If there is abuse by individual military police, the military investigates and the INDIVIDUAL is held accountable and punished by the Military.

It makes me soooo angry that a court agrees to hear this garbage!!!

One more reason why we need CONSERVATIVE judicial appointments!!

These Clintonoid/ Carter Judges made the decision that they have jusisdiction, they don't. They assumed it and nobody told them to drop it. Only congress gives them the authority and congress needs to act on that responsibility. An act of Congress is in order that states the judiciary has no jurisdiction or authority in the military matters. It is beyond a matter of just passing laws, it is a matter of overeaching by the judiciary. Activist leftist judges need to be reined in.

I believe it was ANN Coulter who concluded that "...at least the Liberals have found some people in Cuba they think needed to be rescued." Ann is very observant.

Reading this make me afraid for our future. I just don't get it. The mind set is infuriating. What does it take to make these people see the light? Do they justify their defense of these AlQaida members that have sworn allegiance to Bin laden by saying they aren't the actual murderers of 9/11?
Maybe the only way they'd feel different is if their child or parent or spouse had slowly burned in the trade centers, before frantically trying to call home, or had to make the terrible decision to jump 100 stories to their death. Or if a loved one had been terrorized for more than a few moments knowing they were aboard a plane that was going to be used as a missile to kill their fellow Americans, maybe even their President. I am afraid that 9/11 did not unite our country. It showed us how ignorant and blind the liberals really are. The enemy from within.

They can't and won't see the light. You cannot deal with them as if they will have any understanding. Nick Berg's father is a case in point. Nick's sister gets it, unfortunately the dad is out of it.

IMHO, it's a mistake to attribute the liberal mindset to "ignorance". They're more than aware of the issues involved, but it is overridden by their obsession for political power and control which has been, hopefully, irretrieveably lost. They're heavily engaged in a war...but not with terrorism.
