I just got this from Judicial Watch, how in the world does she get away with this stuff?


Judicial Watch Statement

Regarding the Senate Ethics Committee’s Refusal to Punish Hillary Clinton for Campaign Finance Fraud



(Washington, DC) Judicial Watch president Tom Fitton offered the following statement today regarding the Senate Ethics Committee’s recent decision to dismiss Judicial Watch’s ethics complaint against Hillary Rodham Clinton for her personal role in a campaign finance scandal.



“Hillary Clinton’s friends in the Senate decided to give her a free pass in the run up to 2006 and 2008 elections. They first tried to ignore the issue, and then failed to undertake any serious investigation of the matter. The evidence is clear. Hillary Clinton knew her 2000 campaign failed to report more than $700.000 in contributions. She never corrected the record. Senator Clinton should at least be reprimanded for violating campaign finance law and for bringing shame on the United States Senate. Instead, the Senate Ethics Committee shirked its duty rather than hold to account one of its own.



“As political corruption scandals continue to dominate the headlines, how much longer can Members of Congress ignore rampant corruption among their ranks? The American people are fed up with politicians who look the other way while their colleagues violate the law.”



In January, the Federal Election Commission, in response to a Judicial Watch complaint, fined New York Senate 2000 $35,000 for failing to accurately report $721,895 in contributions from former Judicial Watch client Peter Paul. (New York Senate 2000 is a joint fundraising committee consisting of Hillary Clinton’s campaign, the Democratic Senatorial Campaign Committee, and the New York State Democratic Committee.) Last year, the Department of Justice attempted to convict David Rosen, Hillary Clinton’s top fundraising aide, for his role in the scandal.



Judicial Watch filed its Senate Ethics Complaint to hold Hillary Clinton personally responsible for her role in the scandal. Judicial Watch also cooperated with the Justice Department in its investigation – leading to the criminal indictment and trial of Rosen. Over 42,000 Judicial Watch supporters petitioned the Senate Ethics Committee earlier this year to investigate the Clinton campaign finance scandal.

Much as I regret having to point it out, I think the answer to that question is contained in the 2nd and 3rd paragraphs of the Senate letter:

As you note in your May 6, 2005, letter to the Committee, "Mr. David F. Rosen, the Director of Finance for Sen. Clinton's 2000 election campaign, [was] under indictment for causing false reports to be submitted to the Federal Election Commission ("FEC") in connection with the August 12, 2000, fundraiser." Senator Clinton was not charged in that case and, in his opening statement at Mr. Rosen's trial, the Department of Justice prosecutor told the jury that it would "hear no evidence that Hillary Clinton was involved in way, shape or form" in the matter at issue. Mr. Rosen was acquitted.

The allegations both of fact and of violations of federal election campaign law forming the basis of your complaint to the Committee were also, in material part, the basis of a complaint by your former client, Mr. Peter F. Paul, to the FEC concerning Senator Clinton, among others. The FEC is the federal government entity charged with primary jurisdiction over interpreting, applying and enforcing federal election campaign laws, rules and regulations, including the reporting laws, rules and regulations at issue in your complaint. ... In its December 29, 2005, letter to Mr. Paul informing him of the resolution and conclusion of the matter about which he had complained, the FEC stated with regard to Senator Clinton and the other respondents not a party to the conciliation agreement, "The Commission found no reason to believe they violated the [Federal Election Campaign] Act or Commission regulations in connection with this matter."...


So, unless someone can convince me otherwise, it looks like the proper authority having jurisdiction for upholding the law was the FEC, and that for whatever the reasons may have been, the case was lost prior to its referral to the Senate Ethics Committee. Under the circumstances outlined above - if truly represented - I don't see how the Ethics Committee could have acted otherwise (wishing doesn't get it done - as evidenced by the lack of indictment on Karl Rove and Truthout's position).

Anker,

I see your point regarding ethics "rules", but aqccording to this she had about $282,000 left after her 2000 campaign and that number was reported in December of 2000.

I would still like to know what happened to that $720,000 from that fundraiser!
