That's a pretty good bit of research/sleuthing there and, assuming it is correct, adds more fuel to the fire.

Somewhere in the constitutional amendment process, ratification by all 50 States of the Union is also required, no?

I have an inkling we're all gonna be learning about that process...sooner than later.

A constitutional amendment requires a vote of two-thirds of both houses of Congress and must be ratified by three-fourths of the State legislatures or State conventions.

Alternatively, two-thirds of the States may call for a Constitutional Convention. Still need three-fourths for ratification, though.

Plus, it's not an overnight process. Ratification by the states can take years. Case in point was the Equal Rights Amendment for women that never did get ratified by a sufficient number of states, in the alloted time.

Obama's term, would likely expire before such an amendment could be ratified, and he cannot take office unless he qualifies under the current requirements. This is the same sort of thing bandied about by Ahnold supporters, to get him to qualify for President. Of course those supporters ignore his lack of administrative abilities in California which is close to bankruptcy under his leadership.

It really does not matter since we will never know the truth about where he was born. I believe his Birth Certificate will never be released.

Ahnold has turned out to be even worse than Davis.

The recall was well-intentioned, I suppose, but the results have been a huge freaking joke.

Ahnold has turned out to be even worse than Davis.

The recall was well-intentioned, I suppose, but the results have been a huge freaking joke.

Whipping post, whip, politician...some assembly required....

There is still a strong rumor circulating that Obama "took care of the birth certificate matter" when he went to visit his dying grandmother. It wouldn't be beyond belief nowdays.

I don't think it matters who the Gov. of Ca. is.
They are going down the tubes out there no matter what anyone does. A state full of socialists is doomed to failure.

They cite the Constitution’s requirement that presidents be “natural born citizens.” They want the election declared void if Obama doesn’t deliver an original birth certificate — subject to an inspection by forensic experts — to be sure.

One litigant’s U.S. Supreme Court filing is scheduled to be discussed in private by the justices later this week.

Justice Clarence Thomas distributed to his colleagues a request that the high court weigh in before the Electoral College makes Obama’s victory official later this month. The justices may decide in a Friday conference whether to hear or cast away a lawsuit dismissed in a lower court and appealed by a retired New Jersey lawyer named Leo C. Donofrio, who also has his own Web site.

Because he competed against Obama on the state ballot, Keyes may have the strongest legal standing of all the post-election litigants to have his day in court, legal experts said.

“Because of the legal filings … ” a health director spokesman told The Kansas City Star, “we have been advised by our attorney general not to conduct interviews.”

That surely will make the rounds of the true believers.

With another major inroad into the MSM (and now picked up by Drudge), Obama's hometown "Chicago Tribune" airs the story. While the author typically attempts to tarnish the legitimacy of the Donofrio lawsuit by association with other thus-far failed Obama eligibility initiatives, he fails to report the unique grounds upon which Mr. Donofrio brings this suit (this AIN'T about a birth certificate), while acknowledging that a SCOTUS dismissal is no fait-accompli...

The U.S. Supreme Court will consider Friday whether to take up a lawsuit challenging President-elect Barack Obama's U.S. citizenship, a continuation of a New Jersey case embraced by some opponents of Obama's election.

The meeting of justices will coincide with a vigil by the filer's supporters in Washington on the steps of the nation's highest court.

The suit originally sought to stay the election, and was filed on behalf of Leo Donofrio against New Jersey Secretary of State Nina Mitchell Wells.

Legal experts say the appeal has little chance of succeeding, despite appearing on the court's schedule. Legal records show it is only the tip of an iceberg of nationwide efforts seeking to derail Obama's election over accusations that he either wasn't born a U.S. citizen or that he later renounced his citizenship in Indonesia.

The Obama campaign has maintained that he was born in Hawaii, has an authentic birth certificate, and is a "natural-born" U.S. citizen. Hawaiian officials agree.

Among those filing lawsuits is Alan Keyes, who lost to Obama in the 2004 Illinois Senate race. Keyes' suit seeks to halt certification of votes in California. Another suit by a Kentucky man seeks to have a federal judge review Obama's original birth certificate, which Hawaiian officials say is locked in a state vault.

Other suits have been filed by Andy Martin, whose case was dismissed in Hawaii, and by an Ohio man whose case also was dismissed. Five more suits, all later dismissed, were filed in Hawaii by a person who is currently suing the "Peoples Association of Human, Animals Conceived God/s and Religions, John McCain [and] USA Govt." The plaintiff previously sought to sue Wikipedia and "All News Media."

The most famous case questioning Obama's citizenship was filed in Pennsylvania in August on behalf of Philip J. Berg and sought to enjoin the Democratic National Committee from nominating Obama. The U.S. Supreme Court declined to accept the case. Earlier, a federal judge rejected it for "lack of standing"—ruling that Berg had no legal right to sue. In cases like this, judges sometimes believe the matter is best left to political institutions, such as the Electoral College or Congress, said legal scholar Eugene Volokh of the University of California at Los Angeles.

The remaining case with the highest profile is Donofrio vs. Wells. Because it was distributed by Supreme Court Justice Clarence Thomas to other justices for conference, it gained undue importance for people unschooled in how the court works, Volokh said.

Many petitioners seeking stays of pending events have their cases distributed to the full court, he said. Of those, Volokh found that 782 were denied in the last eight years while just 60 were heard—and not all of those ultimately were successful.

Establishing the legitimacy of Obama's eligibilty to serve as POTUS would be a tremendous service to both Obama and to this nation. Hopefully the USSC will have the wisdom and COURAGE to see that this Constitutional mandate is both respected and upheld...by SOMEONE.

P.S. - Given Mr. Donofrio's rather clear description of the grounds for his lawsuit, I'm amending the topic title to reflect that reality.

On Monday morning the Supreme Court will also release its decision regarding whether to hear the case by attorney Leo Donofrio who challenged the failure of the New Jersey secretary of state to verify the eligibility of the Presidential candidates scheduled to appear on the ballot.


The press conference is scheduled to begin at 1:30 pm.

The people over at the "Federalist" have done a remarkably good job at defining a natural born citizen. Their article goes back to the founding fathers and how the British "natural citizenship" definition was the reason for forcing Americans into the Brit Navy. This issue was defined by blood in the War of 1812. Good article, and I recommend it at the link below.
