A big deal, just reported by the AP:


In a defeat for Democrats, a federal judge in Florida says thousands of "provisional ballots" won't be counted if voters cast them in the wrong precinct.

The Florida Democratic Party had sued state elections officials, arguing that a new federal law required that wrong-precinct votes be counted. State officials disagreed, saying that Florida law makes it clear that only votes cast in the correct precinct can count.

Judge Robert Hinkle's ruling is at odds with similar cases in Ohio and Michigan. There, judges ruled that provisional ballots at the wrong precinct must be counted.

I read something about this a few days ago which I can't readily locate. As I recall, Florida's law is more specific in wording than some of the other states - which is what, I think, was being invoked here.

WOW.
This one is a MAJOR victory to our cause.

Effectively blocking liberal loonies from voting the same person at 30 differnet counties (which they currently are doing in Wisconsin).

I don't care much about BOR, but I agree with him on ONE thing.

I THINK Bush will win Florida, the election will be decided by judges in Ohio and Wisconsin.

Florida has it right. The right to vote comes with responsibilities. It means you need to read the newspaper or at least ask where you should vote in your precinct. If a person goes to the wrong precinct without registration card and votes, then votes again in another precinct, and again and again, what kind of mess would that create? It could take days to verify that person only voted once and we, as a society, should not have to bear the cost of the stupidity or cheating of a person who will not follow the rule of law. Plus, I accept the law of one person one vote. If someone votes more than once or cheats they cancel my vote. Votes are my right to speech and that person just took away my right (or yours) as the case may be. The democrats seem to be attempting to destroy our system and that does not speak well for them. In their lust to win they are destroying the fabric of our nation. If John Kerry had any decency at all he would publicly decry these attempts to game the system.

Did they not have to vote in their precinct before? Just curious. I thought everybody had to vote in their own precinct, how hard is that.

Last election here in GA I was turned down at my new precinct (I guess the transfer was lost or something) I had to go to my old precinct to vote. It was a hassle, but I managed. Point is, if you want to vote you can find a way to do it properly. All you have to do is ask and act. I resent the fact that the proper care to insure the integrity of the vote is not taken by all the states.

I'm getting to the point where I'd willingly support a constitutional amendment giving the Federal Government some jurisdiction over presidential elections--This state-by-state stuff is insanity--We need consistency across the board or our elections are going to be total chaos from here on out--

I want a countrywide voter's database by SSN so that voter registrations can be verified across state lines and college kids can't get away with voting in person in the location where they go to school and by absentee ballot at home (which is happening)--People who have more than one residence ought to be able to chose which one.......ONE.......they will vote in and such a database would both permit and regulate that to everyone's benefit--

I want consistent ID requirements at the time of registration and at the polling place--Anyone who doesn't have a driver's license or passport ought to be able to get a free, state-issued picture ID--This nonsense about how requiring someone to show identification when they cast their vote is somehow disenfranchising is beyond ridiculous--Anyone who finds proving who they are and that they're eligible to vote in a given locale problematic doesn't want to vote very much--Hell, at this point I''m so frustrated about this showing ID business that I'm about at the point where I think we ought to be requiring a DNA sample--

I want people to have to want to vote badly enough to take their little hineys down to the City Hall or the County Clerk's office or wherever themselves to register in person (very narrowly administered exceptions can be worked-out for shut-ins and people in nursing homes and the like) rather than having anyone and everyone taking voter's registrations out in front of Best Buy and turning them in to a registrar who doesn't have the first clue who filled them out or if they're ligitimate--And people should have to show up in person to cast their votes with very limited exceptions for those such as mentioned above--Frankly, I have far less of a problem with having polling places open for two weeks to facilitate that than I do with millions and millions of absentee ballots floating around and Lord only knows who's really casting those votes--

Yes, I'm going militant about this--Having fifty different sets of rules and fifty state court systems interpreting and, too often, re-making those rules at their whims has left us with a system of elections that's completely out-of-control and in times such as those we now live in, there's just too much at stake to constantly have almost half of the Country questioning, if not denying, the legitimacy of the POTUS/Commander in Chief--C

Uh...I am frustrated too, but I caution against thinking the federal govt is the answer. I am generally against giving the Fedral govt any more jurisdiction than they already have.

I agree we have enough problems with the feds controlling the things they already control. Besides thats just another slide torwards socialism.

there are other ways to conform it....
the person in charge of voter registration from each state should all meet together and go over their rules and refine them.... get them down to where they agree and then put thru the changes into state law if needed. They should standardize the forms and procedures.

It has always been a requirement to vote in your own precint in the state of Florida.

They have been very lenient in enforcing this law in the past. I am glad they are enforcing it now.

The problem is that most Kerry supporters are too stupid to thoroughly read the instructions and fail to read through ALL voting materials BEFORE casting their ballot.

I predict alot of Kerry ballots getting thrown out due to their own stupidity.

I'm pretty confident that Bush will win FL. It's OH that I'm worried about. Bush needs OH and things are not going well for him there. The judges are ruling againsy him on things like the "precinct rule" and Kerry seems to have all the momentum in the state's polls.

If Bush wins FL and loses both PA and OH, he could still win by taking 2 of the following 3 states: MN, IA, WI
