Maybe this has been covered before, but, what I want to know is if the AP can sue for President Bush's service records, why can't Fox or maybe even the Swiftvets sue for Kerry's medical records?

You can sue anyone for just about anything. That said, it won't prevent you from getting laughed out of court. In the case of AP, they have sued for the records and Bush has said, "I don't have them" and the courts have said to AP, "Prove that he is lying or don't waste our time."
That's pretty much (IIRC) where the issue stands. Besides, suits are slow. The only reason AP did it was to generate press coverage on a story that was long dead.
