Supporters of Terri Schiavo's right to life scored a big victory late Friday when a Florida judge ordered her feeding tube to remain for an additional three weeks.

"Pinellas Circuit Court Judge George Greer made his decision after pleadings from the woman's parents, Robert and Mary Schindler, that they need more time to pursue additional medical tests which might prove their daughter has more mental capabilities than previously thought." the AP reported.

The judge's stay will remain until March 18. But the legal battle to keep Terri alive is far from over.

Fla. Governor Jeb Bush has also ordered the state to investigate allegations Schiavo has been abused or mistreated. The state is reportedly seeking a 60-day delay in removal of the feeding tube.

Their skin cracks, their tongue cracks, their lips crack. They may have nosebleeds because of the drying of the mucous membranes, and heaving and vomiting might ensue because of the drying out of the stomach lining . . . death by dehydration takes 10 to 14 days. It is an extremely agonizing death."

Dignified? If you did that to your pet dog, you'd be locked up for animal cruelty.

Her parents have fought his efforts but Pinellas Circuit Court Judge George Greer ruled that Schiavo can have her feeding tube removed on March 18.

The Schindlers' attorney, David Gibbs, said Greer had indicated he will not hear the divorce request and five of the other motions filed Monday, but that only means that the matters are now on their way to being appealed.

Appearing at a rally in Jacksonville, the Schindlers called on Gov. Jeb Bush to look into the circumstances that led to their daughter's 1990 collapse and asked Attorney General Charlie Crist to investigate whether Terri Schiavo's civil rights have been violated.

``We have filed divorce proceedings because of (Michael Schiavo's) total disregard for Terri as his wife,'' Bob Schindler said. ``He is married to Terri, but he is living with another woman and he has two children by her. It has become quite obvious that his priorities are not in Terri's best interest.''

``Remaining married to him is an embarrassment,'' Gibbs said.

Michael Schiavo's attorney, George Felos, called the new motions little more than an attempt to clog the case with further delays. Felos has said even if Michael Schiavo were to divorce his wife, any new guardian would be obligated to remove Terri Schiavo's feeding tube because the court has ruled it is her wish not to be kept alive artificially.

``I think everyone knows the parents are going to try anything, including throwing in the kitchen sink, to frustrate the court's final judgment and Terri's wishes,'' Felos said.

Other motions by the Schindlers ask that some news reporters be allowed to see Terri Schiavo's interactions with her parents, since they contend she responds to them; that they be allowed to take pictures with her before she dies and that those photographs not become Michael Schiavo's property, as a current court order now requires; that she be allowed to die at home; and that they be allowed to bury her rather than the cremation her husband has planned.

The arrogance of doctors involved in this case declaring her a vegetable is beyond pale. We are at such a primitive medical level and understand very little about the brain. Wonder what the left would say if she woke up from her trauma. The brain has an unbelievable ability to heal itself over time.

The Department of Children & Family Services sought to intervene in the case to investigate allegations of abuse and neglect by Terri Schiavo's husband, while Republican lawmakers crafted a bill requiring that incapacitated people be given water and nutrition unless a living will directs otherwise.

Lawyers for DCF told Judge George W. Greer the agency wants as much as a 60-day delay in the removal of the feeding tube to investigate the abuse allegations.

DCF supervisor Susan McPhee testified the accusations include denying the severely brain-damaged woman some medical treatment and therapy, and isolating her in her room with the blinds closed.

"This is a heightened situation because we are talking about the life of Terri Schiavo," DCF attorney Kelly McKibben said.

Michael Schiavo's attorney, George Felos, argued DCF has no legal right to interfere and Greer has no jurisdiction to allow it. He said he believes the agency's last-minute attempt is politically motivated, especially since dozens of previous complaints to DCF have failed to yield any evidence of abuse.

"DCF is simply acting as an arm of the executive branch to try to undo a court order they don't like," Felos told reporters.

Greer said he would rule on the DCF request as early as Thursday.

In Tallahassee, a House committee approved a bill requiring doctors to provide nutrition and hydration to incapacitated patients who didn't leave an advance directive. It passed 7-4 on a party-line vote and still needs approval from two more committees before facing the full House.

Also Wednesday, Greer denied two motions by the woman's parents, Bob and Mary Schindler. One asked for new medical tests to determine if the 41-year-old woman has more brain activity than previously thought. The other asked that the order allowing removal of the woman's feeding tube be thrown out because the judge mistakenly discounted the testimony of a witness during a trial to determine Terri Schiavo's end-of-life wishes.

Michael Schiavo contends his wife, who collapsed 15 years ago, suffered severe brain damage and would not want to be kept alive artificially. Her parents say she had no such death wish and believe she can get better with rehabilitation.

Terri is NOT on a ventilator. She is NOT being kept alive by any extraordinary means.
She is awake, NOT in a coma.
She cannot swallow food or water, however she does swallow her own saliva.
Her husband has refused to let her have therapy to teach her to swallow
food and water, therefore she has a feeding tube inserted into her stomach.

She is a living, breathing human being!!

At a news conference on Capitol Hill in Washington, Sen. Sam Brownback, R.-Kan., said a new bill to aid the disabled Florida woman is on an expedited route and has the potential for immediate Senate passage. Senators are being asked if they object to the bill, the Incapacitated Persons Legal Protection Act, with the hope that a unanimous consent agreement might be reached on the bill, he said.

Schiavo's feeding tube is scheduled to be removed March 18 after which she would die within days of dehydration and starvation.

“If there is no objection to it, it could pass even yet today,” Brownback said. “That may or may not happen.”

The House of Representatives has a similar consent mechanism, Brownback said, but it is uncertain how quickly it will act on the measure.

The legislation would give Schiavo and other incapacitated people the legal protections often associated with death row inmates. The measure is based on the “writ of habeas corpus,” which provides the effected person the opportunity for a court review to determine if his/her due process rights have been protected.

The bill is S. 539 in the Senate and H.R. 1151 in the House. Sen. Mel Martinez, R.-Fla., and Rep. Dave Weldon, R.-Fla., are the lead sponsors.

“Anybody concerned about establishing or pushing for a culture of life," Brownback said, "has to be concerned about what this case says about America today, about what it says about our court system, about what it says about the protection of the most vulnerable and the weakest in this society. And I hope and pray we can get this law passed in a timely fashion to be able to keep hope alive."

State legislators in Florida also are considering a bill that could aid Schiavo. That bill would prevent similar people in Schiavo's condition from having their feeding tube removed, unless they had stated it beforehand in writing.

"[Terri's] situation has deeply moved and distressed our client Mr. Herring who has been observing the case in the media, as millions of others have, for about a year," Allred told reporters.

"He recognizes that unless something is done immediately, Terri
Schiavo is not likely to survive very long after March 18. Knowing that time is of the essence and realizing that he is fortunate enough to be able to help, he has decided to take action."

Continued Allred: "He contacted me and retained my law firm to convey the following offer to Terri's husband. If Mike Schiavo agrees to transfer the legal right to decide all of Terri's current and future medical decisions to Terri's parents, then Mr. Herring will pay Mr. Schiavo the amount of $1 million (subject to court approval of Terri's parents as her conservators or guardians)."

The money was deposited in Allred's law firm's client trust account. She says Schiavo has until 4 p.m. Monday to accept the offer.

Herring, a believer in the promise of stem-cell research, said he thinks if Terri is kept alive, her condition could improve.

"After viewing video of Terri on television, I came to the belief that there was hope for her," Herring said. "As events have proceeded in the legal battle, it became clear to me that if something was not done for Terri, that all hope for her would be lost. …

"I believe very strongly that there are medical advances happening around the globe that very shortly could have a positive impact on Terri's condition. I have seen miraculous recoveries occur through the use of stem cells in patients suffering a variety of conditions."

Herring says he is not affiliated with any group but simply "a private individual who is looking to bring hope to Terri's family."
In a related development today, Circuit Judge George Greer rejected a request by the Florida Department of Children & Families for a 60-day delay in the tube-pulling so it could investigate allegations of abuse and neglect by Schiavo's husband.

Terri Schiavo's estranged husband and legal guardian, Michael Schiavo, has consistently not acted in her best interests.

Many stories in the media at this time are about Terri Schiavo in Florida. They center on the battle between her parents, who want her to live, and her estranged husband, who has legal permission to cause her to die by removing her food and water on March 18.

Depending on the media source, many of those stories are giving a one-sided view into Terri's condition and her husband's motive. The intent of this paper is to present a background to the case, which has gone on for years.

Terri has been neurologically disabled since 1990, when her heart stopped and her brain was deprived of oxygen for five minutes. She is physically and mentally handicapped and unable to speak at this point, but she is in no way on the brink of death.

She breathes on her own and is not connected to a ventilator or any other artificial life support.
Other than her disability, Terri is in good health.
Because she cannot swallow at this point, Terri is fed through a tube into her stomach. Medical professionals believe that, with therapy, there is a good chance she could re-learn to swallow.
Removing Terri's food and water would cause a slow, torturous death of 10-15 days.

Terri's estranged husband and legal guardian, Michael Schiavo, has consistently not acted in her best interests.

After Terri's injury, Michael melted down her engagement and wedding rings and made one for himself. He had her cats put to death.
In January 1993, he won a malpractice award of $1.6 million, including $600,000 for him personally.
In the malpractice trial, he testified of his love for Terri, his intent to use the money for her, and his commitment to remain faithful to his marriage vows.

He promised repeatedly to provide rehabilitative care for Terri, but within months of the award he stopped providing physical therapy, dental care and even basic medical care for her. As a result, she has had five teeth extracted.
Later that year, he refused to allow Terri to receive antibiotics for a urinary tract infection, which if untreated would have led to her death. However, the nursing home staff defied his orders and treated her.
He has refused to allow a priest to visit Terri, a Catholic, to administer holy communion.

Michael has admitted being involved with multiple women since Terri's illness and has lived in adultery with a woman since 1996; they have two children.

Far from being a "vegetable," Terri is generally responsive and alert to her environment.

She consistently responds to people who visit her with smiles, frowns or sullenness, depending on who the person is.
Her eyes follow guests and objects around her room.
She moves, laughs, cries and vocalizes emotions.
She responds to questions and instructions.
According to a certified speech therapist, Terri attempts to form words and has been heard saying "yes," "no," "Mommy," and, possibly, "Help me."
She responds to music.


Although her husband's doctors have testified that Terri is in a persistent vegetative state (PVS) with no hope of improvement, other doctors disagree. Dr. William Hammesfahr, a neurologist who specializes in the treatment of brain injuries, has spent approximately 12 hours examining Terri. At an October 24, 2003, press conference, he said that Terri is not in a PVS because:

She responded to his commands for a standard strength test, even though she has lacked physical therapy for more than 10 years. She pressed her leg against his hand as he pressed down.
He observed Terri responding to commands to move her limbs into uncomfortable positions--definitely not involuntary reflexes, as her husband's doctors have asserted.
By definition, if there is a response to the outside world, the patient isn't in a PVS.
Dr. Hammesfahr says that he believes Terri could improve and re-gain some (at least) of her faculties.

In their battle to put Terri to death, it is apparent that Michael Schiavo's lawyer and key medical witness have a definite agenda.

Attorney George Felos is a member of the notorious pro-death Hemlock Society, and the Amazon.com entry for his book says he is "spearheading a social revolution to enable death with dignity in the state of Florida."

Dr. Ronald Cranford is a leading proponent of the pro-death movement.
He has testified that spoon feeding is "medical treatment."
In an op-ed in the Minneapolis Star Tribune, he supported the starvation of people afflicted with Alzheimer's disease.
He spent about 45 minutes examining Terri.

As the days tick down until March 18, Terri's parents and their lawyers continue to try to get the judge to change his mind and to rescind permission for her feeding tube to be removed. I've written to Gov. Bush, who has really gone above and beyond to do the right thing in this case. I cannot believe that the most powerful executive in the state, the man who can commute death sentences, cannot stop this crazy judge.

I requested that, if this judge persists in having this woman starved to death, that the Gov. use his excutive power to make the judge be with Terri during the entire time she is inhumanely starved to death. If he's going to kill her like that, he should be forced to watch it. Preferably by being chained to the bed.

There is no question there is something really wrong in this case. You have a family who wants to take care of their daughter and agree to forego all insurance money left over; they just want to allow her to live. You have a "husband", who from earlier information was physically abusive, who wants his wife dead. Who has refused needed physical therapy and even tried to withhold treatment for infections.

This "husband" has started another family with another woman. To me, that makes his guardianship null and void. He obviously has a conflict of interest. After all, he has spent over half a million dollars of the insurance money meant to take care of Terri on his lawyers trying to kill her. What is wrong with this picture?

He clearly wants the woman not to recover. What is he afraid of if she regains the ability to speak?

The Florida Baptist Witness reported that Terri's father, Bob Schindler, while speaking at a prayer vigil in front of the Woodside Hospice in Pinellas Park, where Terri resides, told participants that Mel Gibson telephoned him March 11 and said he supported the family's efforts to save their daughter.

Schindler quoted Gibson as saying the Schindler family should "never give up and continue to pray."

Later, Gibson faxed Schindler a prepared statement.

Gibson's statement reads:

"I fully support the efforts of Mr. & Mrs. Schindler to save their daughter, Terri Schiavo, from a cruel starvation. Terri's husband should sign the care of his wife over to her parents so she can be properly cared for."

Terri Schiavo is set to lose water and food on March 18, when a court order expires that gave her parents additional time for legal motions.

"We are very grateful that Mr. Gibson has come forward and issued such an encouraging statement on such a delicate matter," Schindler said in a statement released Saturday.

"He was extremely supportive in our telephone conversation. Mr. Gibson told me he believes there is hope for Terri and that he knows of people in similar circumstances that have improved."

In a previous Hyscience post, Carole Lieberman, M.D., M.P.H., Psychiatrist and expert medical witness, and the author of the book, Bad Boys: Why We Love Them, How to Live with Them and When to Leave Them, was quoted as saying, "I have studied men who exhibit pathology in their relationships with women. Profiles of the twelve different types of bad boys are explained. Michael Schiavo fits the profile, described in the book as the Prince of Darkness (see chapter 13). O.J. Simpson was cited as a classic example of this type, and there are indeed similarities between the two men. It is especially significant to note that O.J. flew into a homicidal rage when he realized that Nicole was totally abandoning him, as is characteristic of these impulsive men who most dread being abandoned by their woman. Similarly, Michael Schiavo was likely to have known that Terri had begun making plans to divorce him, since she had told a coworker and family member. Stalking is characteristic of this type of man, as well. And a girlfriend of Michael’s, Cindy, accused him of stalking her in 2001."

This is the story of "Cindy," and the deposition that she had to be forced to give, out of her fear of Michael Schiavo. Terri was also afraid of Michael, but of course Michael has been hard at work to make sure that she can't give a deposition as Cindy has!

In late 1991, 1½ years after Terri’s collapse, Michael Schiavo became involved in an intimate relationship with Cindy Shook. The romance continued for approximately one year. It can be documented that the two spent a weekend at the Don Caesar hotel in St. Petersburg Beach and they also contacted a Century 21 Realtor on the premise of purchasing a home.

In May of 1992, at the apex of the romance, Schiavo had Terri’s 2 pet cats euthanized to clear the way for his moving in with Cindy and her pet dog.

In the summer of 1992, Schiavo moved into his parent’s home. We can speculate with reasonable accuracy, it was at the instructions of his attorney, since the living arrangement would be contrary to Schiavo’s "loving husband" image they were projecting for the upcoming November 1992 malpractice trial.

In April 2001, Cindy Shook (married name Brasher) was interviewed by an investigator working in Terri’s behalf. Unwilling to come forward because of her immense fear of Schiavo, Cindy had to be subpoenaed and was then subsequently deposed on May 8, 2001 to try and learn more regarding her intimate knowledge of Michael Schiavo’s character traits.

Excerpts; May 8, 2001 Deposition:

Cindy Shook describing Schiavo’s possessiveness.

"he’s very jealous. He stalked me at my…at where I worked after I stopped dating…when he would get mad at me he would tell me, I would rather be laying in bed in the nursing home with her than with you. I mean he can be the most incredibly mean person"

When asked if she were afraid that Michael would physically harm her or if he would harm children.

"I am concerned about retaliation because I have a child -I have children and a husband. I know him, I know what he told me I said he could be a very mean person."

She spoke of how Schiavo stalked her for close to a year after the breakup and that she received repeated phone calls.

"He came on the floor looking for me several times. I felt it was out of character for him to get a job as an orderly at the hospital That was concerning to me. When he would come up to the floor looking for her she was not scared the first time but later was scared.

In town I would look up when I was driving…not at my work- she would look up in the rear view mirror and there would be Michael Schiavo. I would look up and he would be behind me in traffic. It continued for several months after he didn’t work at the hospital. She would change lanes, try to make a turn and he would do the same. He did this about ten times.

One time he was behind me in traffic he got next to me in a two-lane going the same way, and he changed lanes basically right on top of where I was at, and I had to swerve not to be hit. I had to swerve off the road. Michael ran me off the road. I considered it as stalking, dangerous and guessed potentially life threatening."

Cindy thought about getting a restraining order. She talked to an off duty police officer in her building

They discussed marriage. She said Schiavo asked what would you do if I asked you to marry me. He never discussed getting a divorce.

Cindy said Schiavo got angry when asked questions about Terri saying:

"this had destroyed his life and he was being robbed of a normal life."

Regarding Terri’s care, according to Cindy Shook, Michael Schiavo said,

"How the hell should I know we never spoke about this, my God I was only 25 years old. How the hell should I know? We were young. We never spoke of this."

THEY NEVER SPOKE OF THIS! Yet now Michael claims that Terri's wish was to die of starvation and dehydration, and the infamous Judge George Greer rubber stamps it. Why?

Early Employment: Michael Schiavo’s initial employment in Florida was the onset of employment at six different restaurants over the ensuing 2 ½ years. His length of employment at times was only for two weeks to a month.

Michael Schiavo’s attitude was a major contributor to his chronic unemployment. He had a tendency to outspend Terri’s income, and his inability to retain employment created a serious financial problem, impacting their marriage. Also, it has been alleged that Michael’s restaurant environment introduced him to drugs.

Some Background Information: Most people, particularly Terri, were easily intimidated because of Michael’s size. It has been documented that Michael had rages of anger and would use his physical stature to bully people, and as indicated in their attached personal experiences and affidavits, it was mostly women that were the subject of Michael’s episodes of anger.

In the early 1990’s, Michael Schiavo’s treating psychiatrist, Dr. Peter Kaplan, stated in a phone conversation with Terri’s father, in regards to a violent episode occurring between Michael and Terri’s younger sister Suzanne, that Michael was potentially dangerous and should a situation re occur, to call the police.

In a deposition from November 1992, that Michael admitted Dr. Kaplan prescribed Welbutron, Paneior, Elavil and Prozac medication to treat his condition.

Additionally, contrary to everything Michael admittedly learned in his CPR training, he did not turn Terri over and clear her airway the night that she collapsed. His CPR training could have re-started her heart.

Anybody NOT believe that he tried to kill Terri???
She planned to seek a divorce from him and also carried a life insurance
policy. He claimed that she started choking and collapsed. An expert
who examined the bone scans at the hospital said she had injuries that
suggested she may have been strangled.

He just wants her dead! And he, like the rest of us, is amazed that George Felos and Victor Gambone so openly falsified a medical order to place Terry illegally in a hospice, then conveniently hid the fact from Terri's family until after the fact - WITH NO COURT ORDER![/]
