"It is time to help Terri, instead of just warehousing her," he added. "She would have benefited from treatment years ago, but it is not too late to start now."

This isn't the first time Hammesfahr has discussed Terri's plight.

Last year, he explained that, after examining Terri, he believed that she could eventually eat and drink on her own. He also said he believes Terri would be able to talk and have good use of one arm and one hand should be given proper rehabilitative treatment.

Hammesfahr also said he thought Terri would eventually be able to transfer herself from a wheelchair to a bed.

"The patient is not in a coma," concluded Hammesfahr said after observing Terri. "She responds to specific people best. She tries to please others by doing activities for which she gets verbal praise."

He says Terri's eyes clearly fixate on her family and she tries to follow the simple commands her parents give her.
"She looks at you, she can follow commands," Hammesfahr said.

Dr. Hammesfahr was nominated for the Nobel Prize in Medicine and Physiology in 1999.

3. Seventeen doctors – neurologists, physicians and pathologists, have signed statements in Terri Schiavo’s guardianship proceedings to support new neurological testing protocols for her. This is important because of recent findings that may support the position that Terri is not in a persistent vegetative state and can be trained to communicate in spite of her limitations. Disability advocates across North America are calling for an immediate moratorium on deprivation deaths for disabled people like Terri until these new protocols can be enacted as an updated avenue of testing. From what I've read at Terrisfight.org, a web site set up fighting for her right to live, she hasn't had any treatment or therapy since 1991, by order of her husband. Several documents and depositions there from medical personnel, state that any attempts by them to rehabilitate her meets with their swift dismissal.

Florida courts, read Judge Greer, refuse to remove Schindler as her guardian even after he has blatantly acted against her best interest. Her "wish to die" is based soley on his word and a couple close friends of his.

That leaves me believing any offers of treatment by specialists, such as Dr. Hammesfhar, falls on deaf ears and is declined. Last I heard her family is still barred from even seeing her, ordered by her husband. Just last week, judge Greer denied a motion from her family to feed her by mouth after this Fridays removal of her feeding tube.

Seems the judge wishes her death as strongly as does the husband and his attorney Evil or Very Mad Mad Crying or Very sad

I hope everyone calls or writes their representatives about this situation.

It is clear to me that the euthansia crowd have targeted Florida as a test case. They've done this before. The difference this time is that Greer is in their pocket. He has not allowed any testimony that contradicts his prejudicial position.

What I don't understand is why he can't be forced to recuse himself. A judge with a conflict of interest happens; his rulings violate the law and he should be forced to step down.

What I'd like to see is a new judge in a new jurisdiction. With new tests.

It's clear the "husband" and I use that term losely, has something to hide.

They try to keep the public away from Terri so they can lead everyone to believe she is brain dead or in a coma. She obviously is not or she would have a machine breathing for her. She sleeps and wakes up. Doesn't take a genius to figure out there is some conscious function there.

SO, the precident they are trying to set, by killing this woman, is that if granny has a debilitating stroke, you can simply take her out in the backyard and let her die because it's inconvenient and after all, she wouldn't want to live that way.

Yeah, right.

This case is embarrassing for the State of Florida and a clear example of activist judges. OF course, the balance of powers prevents one branch of the government from ruling over the others. The stupid judiciary is not omnipotent. All it takes is for the legislative and the excutive to join together and put a stop to what the judiciary, in this case a activist judge, is trying to do. For 50 years, the left has created the myth that the judiciary was the final word; it is not. The founders of this counter created the separation of powers and any two branches can over rule any one, including the almighty judiciary.

I hope that Gov. Bush and the legislature join together and impeach this creep for attempted murder. You can't call starving a handicapped person, one who sleeps and wakes up every day, breaths on their own, anything else but murder.

The media need to start showing that this woman is not brain dead or in a coma. Of course, Mr. Schaivo has kept everyone away from Terri and prevented rehabilitation. They have her in a hospice ! A place where people go to die; only because it is convenient for them to kill her there.

I'm going to be on the phone Monday to the Senate and House leaders. What this judge is trying to do does not represent the people of Florida. If people from other states called as well, it sure would spur them do stop this judge. And hopefully, the get the FDLE going over Mr. Schaivo with a microscope.

Are the court records available? I'd love to read how the argument was made for this. I can't figure out how the Judge could justify the decision.
Maybe the Feds need to keep a sharp eye on his bank records and lifestyle..

Felos combined and conspired with Michael Schiavo to arrange for Terri's "free" stay at Hospice Woodside as part of an "exit protocol" designed to advance Felos' self-perceived messianic mission of "helping" incapacitated people to die by categorizing them as "terminal," warehousing them, and depriving them of therapy and rehabilitation services. (Attorney Felos is Director of Florida Right to Die and has testified that he can ascertain a person’s desire to die by “looking into their eyes and letting their spirit speak directly to him”)

10) Investigate Insurance company established in Jan 2001 at the home of Michael Schiavo and his girlfriend/fiancee Jody Centonze. (Jerger and Centonze Insurnace Agency Inc.) Michael is listed on the Board of Directors for the corporation. Note: Insurance is deliberately misspelled in the State of Florida Corporate filing, possibly to avoid investigation.

11) Michael continues to deny Terri the right to receive Holy Communion as part of her Catholic and civil right.

is there anyway we can put pressure on the talk shows oreilly hannity & colmes and msnbc, this is murder, no other word for it, last time a judge in florida messed up oreilly forced him to retire this is what needs to be done again

Why is it that the goverment cannot take her care out of his hands and appoint an guardian to take care of her, they can do it if children are abusied, this is the same, I am so upset to think in this great country this can happen to a helpless human being, does this idiot have any family that can sit him down and talk some sense, the woman he is with now better watch out she could be next , this man is evil and is going to get away with murder

Minnie, this is what Governor Jeb Bush is trying to do.

To make Terri a ward of the State, he ordered the Dept. of Children and Families to do an investigation of abuse and lack of care for Terri.
This investigation must be done to LEGALLY transfer her custody to the
State.
DCF asked Judge Greer for a 60 day extension in order to complete their
investigation. The judge said NO! and Terri's DEATH SENTENCE will commence March 18th. He said the FINAL ORDER for removal of the feeding tube was issued and cannot be changed.

EVEN A MURDERER ON DEATH ROW HAS THE RIGHT TO EXHAUST ALL APPEALS!!!

Schiavo was just quoted on Larry Elder's program, almost made me sick. Larry played a tape of him saying that he still loved Terri and was fulfilling a promise he made to her and how much it hurts him to hear what so many are saying about him Rolling Eyes

If he loved her so much, why is he with another woman and fathering children with her? Why has he forbid efforts to rehabilitate her? Why is he so adamant she be cremated as soon as she dies? Why block her family access to her and have any medical person that doesn't agree she needs to be dead right away fired?

Love? I doubt this guy even knows the meaning of the word. Wedding vows say to love honor and cherish, in sickness and health, good times and bad, until death does them part. Nowhere does it say for one spouse to expedite that death Evil or Very Mad Mad

HB701, the Florida Starvation and Dehydration of Persons with Disabilities Prevention Act.
The bill would require that "courts rule in favor of lifesaving medical treatment unless a patient has stipulated in advance, in writing (such as a 'living will'), before witnesses, that he or she does not wish such treatment."


Governor Jeb Bush is waiting to sign this Bill immediately!!

It looks hopeful the Florida Legislature will get it passed.

TALLAHASSEE, Fla. -- A bill that could prevent the removal of Terri Schiavo's feeding tube later this week was sent to the full House for consideration after a panel approved the measure Tuesday.

An identical measure was to be considered by a Senate committee later in the day as lawmakers rushed to prevent the removal of the severely brain-damaged woman's feeding tube on Friday.

Schiavo, 41, has been at the center of a long and bitter court battle between her parents and her husband, who wants to remove her feeding tube so she can die.

"We need to be able to talk long and hard about this," said Shelley Vana, D-West Palm Beach. "I know that we're trying to meet a deadline, but we have to pass good legislation."

Rep. Aaron Bean, R-Fernandina Beach, argued the hope of saving a single life made the rush necessary.

"We're in a hurry for this bill and we're rushing for a reason," he said.

Court-appointed doctors say Terri Schiavo is in a persistent vegetative state -- and that any movements or sounds she makes are coincidental and not a result of consciousness. Her husband, Michael Schiavo, contends his wife would not want to be kept alive artificially.

Bob and Mary Schindler doubt their daughter had end-of-life wishes and have fought their son-in-law in court for nearly seven years. They also dispute that she is in a vegetative state, saying she laughs, cries, interacts with them and tries to speak.

This is the second time the Legislature has considered measures aimed specifically at keeping Schiavo alive. In 2003, lawmakers passed a bill that allowed Gov. Jeb Bush to order doctors to restore Schiavo's feeding. That law was then thrown out by the Florida Supreme Court.

Tallahassee, FL (LifeNews.com) -- A Florida agency seeking to stop the starvation of Terri Schiavo so it can investigate charges of abuse and neglect against her filed an appeal with a Florida appeals court. The agency hopes to prevent Terri's starvation for 60 days while it looks into the allegations.

On Monday, Florida's Department of Children and Families filed an appeal of Circuit Court Judge George Greer's decision preventing the delay. Papers were filed with the 2nd District Court of Appeals in Lakeland, Florida.

Adult Protective Services investigator Michael Will points to a 1972 decision by the 2nd DCA which held that a trial judge was in error when he prevented the agency from investigating another case. Will hopes that precedent will prompt the appeals court to grant the agency's delay request.

In his ruling, Greer claimed the request from DCF "appears to be brought for the purpose of circumventing the court's final judgment ... in violation of the separation of powers doctrine."

After hearing testimony about the charges of abuse yesterday, Greer told DCF officials, "All of the things (the witness) ticked off ... were all issues that have been in open court in front of the media and in the court files which the media has access to."

Department of Children and Families supervisor Susan McPhee told Judge Greer that Michael has denied her medical treatment and isolated her in her hospice room with the blinds closed and prevented her from going outdoors.

Those are just some of the "30 detailed allegations of abuse, neglect or exploitation" the agency received in a 34-page document in February.

Other DCF concerns include Michael's failure to follow state law and provide an annual guardianship and medical care plan for Terri, failure to provide Terri with medical care and rehabilitative therapy as he told a court he would do, and lack of moving Terri from her bed which has caused her "severe contractures."

"The allegations ... go to the heart of whether abuse, neglect and/or exploitation has been perpetrated by the guardian such that any relief afforded by this court to this guardian prior to the conclusion of such investigation would be tragically misplaced," the petition said.

The Florida appeals court is also considering motions by Terri's parents this week as they, too, appeal Judge Greer's decisions on various matters.

The court has promised an expedited ruling by 5 PM on Thursday, in time for the decisions to make an impact on Friday, when Michael is scheduled to begin the starvation process.


Florida legislation is on track, DCF is appealing their case, any news on how the Federal legislation is moving...?
