First of all, given this came from NYT, I think we've all received another back-handed compliment on the effectiveness of the Swiftees, by being so prominently cited (right up there with Moveon.org - and that should probably be considered high praise/respect indeed from the NYT).

Second, I'd bet my last dollar that the deep pockets on the left will simply find another way to fund and operate their political machine. Or said another way, this latest legislation ain't gonna stop George Soros. So if there is a next round, we'll just have to either follow their suit, or be creative on our own. Just need the advice of a good lawyer...

Fundamentaly, I think this kind of legislation is just plain nonsense. In a country that values free speech (and freedom of assembly), there is always going to be some mechanism with which people with political opinions can orgainze and make their voices heard - both good guys and bad guys. Eventually, this kind of legislation has got to make its way through the courts and be found unconstitutional.

Yes, it's a two-edged sword, but I don't think I'd have it any other way.

"Fraid you're more optimistic than I am, shipmate, that's what I thought about "McCain/Fiengold" too.
Seems more and more, our "elected representatives" are fixin' things so's they don't have to listen to the "folks" any more.

Interestingly, there's this from within the NYT article (emphasis mine):

Quote:
But even if the bill becomes law, it is unclear how much will change. Already, groups like MoveOn.org are operating under another section of the tax code, 501(c)4, which is not covered by the legislation passed Wednesday.

I don't know which section of the 501 code covered the Swifties but it looks like Soros has an advantage going in.

I may be mistaken, but I don't believe McCain/Fiengold has been seriously challenged in court yet (probably because it's just easier to take advantage of other loopholes in the law than to go through the expense and trouble of a court challenge). Eventually, though, I believe this nonsense will be challenged; it has to be.

I believe that John O'Neill is one of the best lawyers around. I am sure that he is watching this. Wink
