That does not change the fact that you seem to be defending the fact that Berger just took copies, and therefore it's okay for that to happen. Is that correct? Do you defend Berger, or condemn him?

If they are "copies" i.e. photocopies of the same image, why would he take more that one "copy" of each document? If I line out a comment, add a comment, and/or redact a comment, the "document" has immediately taken on the character of an orignial based upon my actions.

If there is 1 photocopy of 6 annotated drafts in the "reading room" why would anyone, Hambergler included, suspect that the "Commission" would look beyond the "photocopies" already placed there? Fact is, IMHO, they wouldn't.

This is the assertion. Even if other copies of the annoted drafts existed outside of the "reading room", Hambergler might have presumed that if he walks away with 5 or 6 uniquely annotated versions of the draft it would be extremely unlikely that the "Commission" would ever see the originals or other photocopies of the the annotated drafts. They wouldn't even think to look beyond the 1 photocoy of each annotated draft placed by the staff in the "reading room"

The "documents" had already been photocopied for Commission and witness use.

Common sense says he thought, rightly or wrongly, that he was attempting to eliminate the Commission's access to annotated drafts that woud be unfavorable to himself or the Clinton administration and by inference the Kerry campaign.

Don't give us more of the Demagogic Party spin about "copies".

1, 2, 3, 4, 5, 6, 7, 8, 9, 10 . . . . OK, I am defending nothing, zippo, nadda.

I have stated a fact, that some people want, for some reason, to ignore.

That fact is that he did not take originals. He took copies. He also took his own notes, by the way.

I have also said, and I'm losing track, at least twice that I knew he was committing a crime when he did that.

Do I "condemn" Berger? No, I don't think I'd say that. Nor, if it was anyone else, would I say that. I would say, a-g-a-i-n, that if he took copies of documents, it was a crime. If he took his own notes, it was a crime.

Yes, but he took the "only" readily available photocopies that were available to the Commission and its witnesses. Probably assuming that no one would ever go back to look at the originals.

You really really don't condemn the Hambergler for taking the only readily available photocopy of Code Word Top Secret documents?

Okay, Doug - it just sounded to me like you were defending him.

I'm glad to hear that you're not.

As for conspiracy theories, everyone's allowed to have an opinion, and if it seems that he was sent on mission because of the way the pieces of the puzzle are falling, then it's no less plausible a theory than the one floated immediately after the leak about the timing of the leak being attributable to Republican dirty tricks. Wink

Hey guys, I have an idea -- Why don't we try to get our information from sources other than NewsMax or the New York Post?

How about, hmmm, let's see, the FBI!

I have some predictions -- we will find out that he didn't "take documents on five occasions", we probably will find out that he didn't "stuff documents in his socks", and I believe we will find out that they were all copies, not uniquely annotated versions of anything.

Berger (and/or his lawyer) has said he took some documents. He has said he took his own notes. He said he returned the documents as soon as he was contacted. He has said that apparently he discarded a document(s). He has said that he has cooperated with the FBI since Day one, which I believe was back in October. He has said that he knew what he did was against the law.

For now, that's what we have from someone directly involved. All these stories that were leaked to the press? Who knows? I guess we'll see at some point in the future.

I'll wait, thank you. But that's OK, you guys feel free to well, do what you're doing . . . . . I'll just watch.

Yeah! We're supposed to trust the NY Slimes and MMM? BTW, no one with half a brain reads anything in the tabloid press, left or right, if they want facts and not spin. Yellow Journalism anyone? Read some of the good Weblogs on both sides of the political spectrum and you might find a modicum of truth.

The Hambergler took the "one" available photocopy of each draft from the reading room. You know it, I know it, and anyone with a brain knows it.

You want me to accept the word of the Hambergler and his attorney? Not a chance! I remember Tammany Hall, "Boss" Tom, and Mayor Dick Daley. And don't give us the "timing of the leak spin". September 15th would have been the time for Republicans to leak this.

It was leaked by Demagogocrats to have it hidden by the media in the hype of the Demagogic Convention. Just an opinion. Check with Lanny Davis if you don't believe me!


BTW, Who really won the 1960 presidential election? That is excluding election fraud in Texas (Johnson) and Illinois (Daley)? Nixon!

A new Berger scenario

What was Sandy Berger up to when he "inadvertently" removed versions of a classified National Archives memo that critiqued Clinton administration intelligence and security efforts regarding the millennium celebrations? We still don't know.

But a bigger question is being posed by some of the well-sourced wags with whom we regularly converse. In fact, one says the thrust of the federal investigation now looking into Mr. Berger's actions should center not necessarily on what was taken from the archived files but what was placed in them.

Berger has acknowledged removing his handwritten notes taken during a review of classified documents. That's a violation of National Archives policy. And he says he mistakenly took the copies of the aforementioned memo, different drafts written by Bush-bashing anti-terrorism coordinator Richard A. Clarke. Some of those copies remain missing.

But a new scenario has Berger, who only took notes on an initial visit last fall, placing material -- again, related to the millennium terrorists threats -- into the files on his second and third visits.

And adding an entirely new layer of intrigue to the story is word that telephone calls made by Berger during those latter two visits may have been monitored by an "unauthorized agency."

The House Government Reform Committee says it will conduct a separate investigation into the matter. We trust it will press to learn not only what was placed in those files but to whom Berger was talking and what about.

Hmmm...wonder who that might have been.

If I read the story correctly, an initial confrontation between THK and a Pittsburgh Tribune-Review reporter was testy, but hardly newsworthy. However, after she learned the identity of the reporter, she very pointedly made a dash BACK to the reporter (you can see it in the WTAE tape) and gave him the what-for.

NNN...I think we've found a story....ROFL...

To answer your signature question, Jay,

Kerry's Krew are Klumsy enough not to know the difference between Cat Lo and Cam Rahn Bay, after all they're not locations in Massacommunists.

What's notable in this is that Kerry isn't smart enough to edit the swill spewing from his demagogkettes. But...that's Ok, he doesn't have time to read National Security Briefings either.

Am I mis-remembering or are there some docs still missing? I believe Doug says there are.

Two things amaze me about this story:

#1 That Berger,with his background, would so willfully and knowingly violate security rules.

#2 Like Navy3X...Why?

It also raises the question if he was this sloppy about security when he was National Security Adviser to Clinton.

Something that is missing from the discussion of "copies" vs "originals" vs "unique documents" is this:

The 9/11 Commission was investigating HOW the government (including the Clinton administration) acted/reacted during the years prior to 9/11. The different versions of documents, the handwritten notes in the margins between drafts and final versions are all very relevent to HOW the government (mis)managed the intelligence and foreign policy aspects of the "war on terror".

So when folks say they were copies, you need to parse the facts very carefully. Certainly the facsimile copies of the printed original documents may be available elsewhere, but the copies with Berger's handwritten notes, or Clinton's handwritten notes may provide a DRAMATICALLY different perspective on how and why things happened the way they did. Destroying the "version" that had Clinton's handwriting in the margin might be important depending on what the notes said.

Remember, the NATL ARCHIVES got the specific documents they got because they were "relevent to the presidency"; not because they are just a dumping ground for extra copies of documents...
