ALERT: Sen. John Kerry is upset about the Senate Democrats' filibuster of President Bush's conservative judicial nominees.

He's not upset about the fact that the judicial filibuster is unconstitutional. He's not upset about the fact that a minority is blocking a simple "up-or-down," "yes-or-no" vote on these nominees. He's not upset that these liberal Democrats are stopping the United States Senate from fulfilling its constitutional duty to "advise and consent" on judicial nominees.

NO... he's upset that Senate Majority Leader Bill Frist is speaking out AGAINST the filibusters, at a Christian conference on the all-important issue of reining in our out-of-control courts. Sen. Frist, along with other conservative speakers, will be speaking out against the current judicial war on faith in America, such as the blatant bigotry against judicial nominees that hold strong religious convictions.

Well too bad, Senator Kerry. The fact is, the Religious Test Clause that appears at the conclusion of the Oath Clause in Article VI of the Constitution is very clear: "no religious Test shall ever be required as a Qualification to any office or public Trust under the United States."

But because the left-wing Democrats in the Senate are so opposed to the appointment of judges who would make judgments BASED on the law, instead of MAKING law from the bench, they are stopping at NOTHING to block the conservative nominees -- including applying a Religious Test to several of those nominees. Senate Democrats have now decided that the privilege of serving on the federal bench will be denied to openly pro-life Catholics, which is to say faithful Catholics.

But isn't Sen. Kerry Catholic? Yes, BUT, as conservative talk show host Hugh Hewitt writes, "It is both laughable and pathetic for Senators like Leahy, Tom Daschle, and Richard Durbin to protest their innocence on the charge of anti-Catholicism with the argument that they are Catholics and thus cannot be anti-Catholic. This is a variation on the 'some of my best friends are Jewish' refrain, and would not for a moment be admitted as a serious response in any other civil rights debate involving any other minority. The fact of discrimination is not in the motive of the offender but the effect upon the offended. Labels have nothing at all to do with the reality of bigotry."

TAKE ACTION: In announcing this important conference, Tony Perkins of the Family Research Council stated, "Join FRC Action and churches from across the country on Sunday, April 24, as we host a live simulcast to engage values voters in the all-important issue of reining in our out-of-control courts and putting a halt to the use of filibusters against people of faith. Senate Majority Leader Bill Frist of Tennessee is committed to returning constitutional order to the Senate by requiring an up-or-down vote on these nominees. To do this, he urgently needs the help of every values voter. Without doubt, this will be the most important vote cast in the United States Senate in this term. If this effort fails, the best we can hope for are likely to be mediocre judges who meet the approval of Ted Kennedy, Charles Schumer and Hillary Rodham Clinton. We must stop this unprecedented filibuster of people of faith. The simulcast will originate from Highview Baptist Church in Louisville, Kentucky. Participants joining me include Dr. James Dobson, Dr. Al Mohler, and Chuck Colson."

Because the proposal wasn’t offered by Republicans; it was introduced in 1995 by senior Democrats, including Sens. Lieberman and Tom Harkin (D., Iowa). When it came to a vote, 19 Democrats, including leading blue-state senators such as Ted Kennedy and John Kerry, supported the measure.

Unlike the attempts by Democrats to end all filibusters, the effort by Senate Republicans is limited to the judicial confirmation process. As Senate Majority Leader Bill Frist said Tuesday: “If I must act to bring fairness back to the judicial nomination process, I will not act in any way to impact the rights of colleagues when it comes to legislation.”
