Iraq Murder Charges Dropped Against Marine
Thursday, May 26, 2005

RALEIGH, N.C. — A former Wall Street trader who rejoined the Marines after the Sept. 11 attacks will not be tried on murder charges for killing two suspected Iraqi insurgents, a Marine general decided Thursday.

The decision by Maj. Gen. Richard Huck, commander of the 2nd Marine Division based at Camp Lejeune, ends the prosecution of 2nd Lt. Ilario Pantano (search), whom prosecutors accused of killing the men without justification.

"Down at the unit level, there was never a question about Ilario's conduct and whether or not he did the right thing," Charles Gittins, Pantano's civilian lawyer, said. "It was up in the higher echelons. The people removed from combat situations needed to put more trust in their officers rather than assuming they're guilty."

Sometimes I wonder if JAG officers know what the purpose of an
armed force is? OK, a sign might be a little tacky and maybe he
used a couple of magazines over what was necessary, but two
dead Iraqis doesn't seem unreasonable.

The two were terrorists and somebody remind me, Were they in fact Iraqis? Many of the the terrorist "insurgents" are not.

Kit Jarrell at Euphoric Reality has interview with Pantano's lawyer.
She has been posting updates on this case all along, and has links to all the coverage.

Blogger Exclusive: Interview With Pantano Defense Attorney Charles Gittins
by Kit Jarrell @ 11:24. Filed under 2 Lt. Ilario Pantano
As promised. =)

Kit Jarrell: Was this case harder than others you’ve done?

Charles Gittins: No. Self-defense is one of the best defenses under the law. Even if he was not actually endangered, but if he believed he was, he was entitled to use self-defense. So, I was confident that Ilario was not likely to be convicted of murder.

KJ: Was there ever a time when you thought perhaps Ilario WOULD be convicted?

CG: No. Not after I talked to my client and looked into his eyes. I was not going to second guess a Marine officer who had to make a tough choice in a dangerous place in dangerous circumstances and I had every confidence that a Marine Corps jury would feel the same way. That is one reason why we waived the Article 32.

KJ: Was there ever a time you believed he was guilty?......

Outstanding Lt Pantano!!! This man is a hero in my book! I sent him a congratulatory e-mail with my blessings. If anybody else would thank to thank this fine young Marine officer (formerly enlisted), you can contact him at the website that his mother set up to help him through this:

I received an e-mail back from LT Pantano today thanking me and others who supported him at http://www.defendthedefenders.org/ during this painful and trying time. Lt Pantano is an American hero who did not deserve what the leftist media and others tried to do to him. He is moving on with his life and I'm sure that he will be a success at whatever he choses to do.
