I think no one would argue that Kerry demonstrated against his Country....that being the case, what about this:??

No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

He didn't take the oath prior to "giving aid or comfort."

Yes he did take an oath under the UCMJ which is applicable to this situation in my opinion. However in 1970 you could piss on the nation, sell it to the soviets, and you wouldn't be prosecuted...

Why? The government's fear of riots in the streets.

Hmmmm! Think it might work again? At least in front of the NY Slimes, the Washrag, and the Alphabet channels.

But there are similar constraints against officers in the Armed Forces giving aid and comfort, as well as constraints against negotiating with the enemy outside the perview of the officer's assignments - the possible penalty for THAT being capital punishment.

HA, you may be right:)) I never did riot......now is as good a time as any:) Let me see, do you need a sign to riot? Or do you just have to look WIERD?
