Can we get access to their computers to see if we can find the documents on the hard drives? I would think there should be an investigation to see if they were created on those computers.

I didnt believe these guys could be this stupid. I was wrong so keeping this in mind if they try to hang this on Burkett, I have to say he lives on the same block as Kerry, he is a big fundraiser for the Kerry campaign,. well if they are that dumb dosnt that place it dangerously close to Kerry?
seems to me that implicates Kerry Immediatly/.

I would bet money that the Bush campain will not allow an investagation to start during the election, after maybe, but not during. All an investigation would do is open up a bigger can of worms. Maybe that is what the dems want?

I don't want to get off topic too much, but blame the activist prosecutors and judges from the Clinton administration for expanding RICO. Congress never intended the statute to be used for anything but drug conspiracies.

The unfortunate thing at this point is that (1) Congress has no incentive to change the statute to limit coverage, and (2) since the incorrect interpretation is put there, prosecutors feel compelled to follow suit and expand the law as far as they can.

Man, this is bizarre.

Burkett is a looney toon.

He has a well publicized and documented axe to grind.

And, he was obviously Army Guard and not Air Guard.

What did he know about the case?

The real story here is that CBS ran with it.

What a bunch of maroons.

If the fraudulent documents were sent by fax over phone lines that cross state lines (that is, interstate commerce) that equals WIRE FRAUD. Major federal offense!!!!!

But do we know that the memos actually crossed state lines? I seem to remember hearing that a CBS producer flew to Texas to meet with the source of the documents.

Note that the Washington Post cites Van Os as Burkett's Attorney. Looks Like Van Os once ran for the Texas democratic chairmanship with the strong support of Bill Burkett. Burkett is an acknowledged democrat active enough in the party to be involved in the selection of the state chairmanship a few years ago. This provides a Democratic link, not some disgruntled TANG officer.

Links to two emails from Burkett a few years ago regarding Texas Chairmanship:

http://www.geocities.com/stoutdem/bb525.html

Also, the democrat link is even stronger...
It looks like Burkett's attorney, Mr Van Os is running for Texas Supreme court as a democrat and speaks on his web page about Karl Rove's Desire to take the government away from the people. etc. Again, he is the democratic candidate for Texas Supreme court. Do I smell Ben Barnes anywhere here?

Wait a second.

The DEMS release an ad within days of last Wednesday's 60 Minutes 2 show. The ad uses a clip from the interview.

WOW -- how could the DNC turn around such an ad so quickly? -- Only if they knew it was coming days (weeks or months) in advance -- I smell total complicity with Carvell and gang as the architects.

I can't wait till this is traced back from Burkett to Carvell and McAweful! What a blowback!

Burkett raises cattle in Baird, just out side Abilene.
I knew it was this nut job....

I don't want to speculate, but I could have sworn I saw on a blog somewhere...maybe CrushKerry.com, that some inside Democrat sources worried the memos were from moveon.org. And they were furious too, because that is VERY close to Kerry. Can we trace the link to them?

Updated: Here it is! http://www.crushkerry.com/article267.html

I keep wondering why CBS and Rather would cover for a loon like Burkett - wonder who the Kerry campaign operatives are here in Texas. Also Rather's daughter lives here in Texas somewhere and didn't she have connections to Barnes? Another Texan who has been ruthless in his pursuit of Bush's guard records over the years - Paul Begala. The Kerry link? Just a thought. Wink

Once the fax transfers onto the phone line it enters interstate commerce. Even if the signal never reached a switching station in a different state, the statute applies.

I wish its intention was being fufilled, but unfortunately docford the RICO statute is being used by the feds anytime and against anyone they can to make their case these days. Power corrupts.
