Of course no mention of the 3 lawsuits that were slapped on Carlton Sherwood, the VVLF and Newsmax prior to Carlton Sherwood initiating this action...

WASHINGTON --John Kerry is still fighting at least one leftover battle from his failed 2004 presidential bid.
The Massachusetts senator recently created a defense fund to pay his legal costs in a federal defamation lawsuit filed last fall by a Pennsylvania filmmaker, Carlton Sherwood.
Sherwood alleged that Kerry and a top aide sought to "discredit and silence" him while blocking the broadcast of his anti-Kerry documentary during the final weeks of the race.
The film, "Stolen Honor: Wounds That Never Heal," alleges Kerry's actions as an anti-war activist after he returned home from the Vietnam War harmed American POWs. Kerry lied about atrocities by U.S. soldiers as a leader of Vietnam Veterans Against the War, according to the film.
Kerry has vigorously denied the charges.
"You can count on the right wing reaching into their deep pockets to spread a lie, so our job is to make sure the truth prevails and knock back Republican Swift Boat-style attacks forever," David Wade, a spokesman for the Democratic senator, said Wednesday.
Kerry has not begun raising money using his new legal expense trust, "Fund for Truth and Honor," Wade said. Kerry filed a motion to dismiss the suit in December.
The defamation suit was filed in Philadelphia by producer Sherwood and the Vietnam Veterans Legacy Foundation. Thomas Manning, an attorney for Sherwood and the group, declined comment.

I hear what you say, and believe further that his 'defense fund' is actually a slush fund in anticipation of the Swiftvets returning to action if he makes any attempt to 'rise from the ashes'.
At an absolute minimum, one of Carlton's goals in his lawsuit should be an injunction against sKerry's EVER using the word Swiftboat in a sentence in a negative sense, in any settlement... Not to mention a letter of apology, and writing "I am a Swiftvet, and agree with all that the Swiftvets said about me" on the blackboard 10,000 times. Then a short stint of clapping blackboard erasers for 30 days for atonement....followed by a check written for all court costs and fees by both parties.
In a pond of scum, the Junior Senator from Taxachusetts is still the lowest of the low and offers no redeeming qualities (other than being a 2 time billionairess con artist IMHO) so I'm pretty sure we can't get him on the witness stand in his own defense.
