(AP) A federal judge dismissed a filmmaker's defamation suit against Sen. John Kerry, saying remarks linked to Kerry's campaign during the heat of the 2004 presidential race amount to political opinions.
Filmmaker Carlton Sherwood sued Kerry and John Podesta, an aide who ran the Massachusetts Democrat's campaign in Pennsylvania.
Sherwood accused them of blocking the release of his documentary about Kerry's anti-Vietnam War activities by labeling Sherwood a "disgraced journalist" and a "Bush hack."
The Sinclair Broadcast Group Inc. canceled plans to air the documentary "Stolen Honor: Wounds That Never Heal" on its stations before the November 2004 election.
U.S. District Judge John P. Fullam said he found no evidence that Kerry personally made any of the statements, and furthermore, found that they were protected opinions.
"I do not believe any of these statements are actionable since they constitute expressions of opinion, and must be viewed in the context of a hard-fought political campaign," Fullam wrote in a ruling issued Thursday.
"More importantly, I am not aware of any basis for holding a political candidate personally responsible for statements made in press releases issued by his party's national committee," the judge wrote.
Kerry created a fund earlier this year to pay to defend himself against Sherwood's suit.

Hmmmm, maybe the Judge is past retirement?

Perhaps he is related to the Judge who saw nothing suspicious in Washington States last Governors race where King County somehow "found" some 3,000 more ballots than they have voters? |

Funny--this is almost verbatim Kerry's lawyers' second appeal to dismiss. So we learn that pols can libel and slander (and calumniate) to their hearts' content as long as they're campaigning. Glad the air's clear on that one.
But what I'd much Rather learn is when is it okay to tell the truth about a candidate "during the context of a hard-fought political campaign"? The rights and reasoning there are a little fuzzier. I guess journalists, "disgraced" or not, lose all free-speech rights along with their reputations if they dare to try telling the truth.

good gracious that dude is old! they need to cart him off to a rocking chair on a porch... or at least test his hearing, speech, conprehension etc.
can he walk? I'm tons younger than that and have trouble walking sometimes!
they really need to set an age for judges to retire...

Age had nothing to do with the ruling. He would have ruled the same when he was young. Ron White is correct. You can’t fix stupid. At any age. _________________ I was going to become an anarchist, but they had too many rules. |

This begs the question, was that judge another of Kerry's cronies? Obviously. That in and of itself begs this question. How much was he paid to let it go?
Kerry is scandalous and so is everyone associated with that man. Pathetic. _________________
