I think we should add an amendment to the Constitution that states, “If a person conducts meetings with an enemy of the United States, during a time of war, with the result being either prosecution or not, then that person cannot ever serve as President of the United States.”

Oh yes, why don’t we add to that, “If a person throws their war medals away they can’t serve either.”

UNITED STATES CODE
TITLE 18 > PART I > CHAPTER 115 > Sec. 2381.
Sec. 2381. - Treason
Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.

TITLE 18 > PART I > CHAPTER 115 > Sec. 2388.
Sec. 2388. - Activities affecting armed forces during war
(a) Whoever, when the United States is at war, willfully makes or conveys false reports or false statements with intent to interfere with the operation or success of the military or naval forces of the United States or to promote the success of its enemies; or
Whoever, when the United States is at war, willfully causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty, in the military or naval forces of the United States, or willfully obstructs the recruiting or enlistment service of the United States, to the injury of the service or the United States, or attempts to do so -
Shall be fined under this title or imprisoned not more than twenty years, or both.

14th Amendment Section 3 to U.S. Constitution
3. No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability


Article 3 Section 3 U.S. Constitution
Clause 1: Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

Does confession in open Senate Committee count?

John Kerry was giving testamony in 1971 and was active in VVAW.

He was not discharged until 1973

WE WAS GIVING COMFORT AND/OR AID TO THE
ENEMY WHILE HOLDING A COMMISSION IN THE
UNITED STATES NAVY.



NOW THE COURSE OF ACTION SHOULD BE TO HAMMER ON THE TREASONOUS ACTS WHILE HE WAS A RESERVIST,AND STILL A COMMISIONED OFFICER OF THE UNITED STATES, NO?

My two posts of Kerry's testimony have the wrong date and reference to the Congressional Record. It was, as others have it, 4/22/71, not 1972.

mcb58,

Kerry wasn't discharged from the Inactive Ready Reserve until 1978. That meant he still held a commission during all of this. This is per John Kerry's own site.

What needs to be done to have these things upheld?
Honestly, does anyone know why those sections should NOT apply to Kerry?
