No felonies just errors in judgement according CBS. That's going to be the final call.
If felonies were committed they were committed by Burkett. His paranoid mind has made his his conviction pretty doubtful with his Lucy story. How do you unwind that lie.

KA-CHING!!!!!!!!!!!
The checks and balance on the media available today are wondrous, a joy to behold, and about damned time!
Apparently some bloggers and RNC researchers have come up with another little ‘OOPS!’ in Rathergate!
We all, I assume, have now seen where the forgeries that supposedly had Killian complaining about pressure to ‘sugarcoat’ Bush’s performance review! No surprise there.
And perhaps no surprise that the head of the Democratic National Committee, Terry McAuliffe would have said:

Terry McAuliffe delivered those remarks at an event held at 11:00 AM on September 8 – MORE THAN NINE HOURS BEFORE THE CBS STORY BROKE ABOUT THE MEMOS!!!!!!!!!!!
Did I say ‘KA-CHING!’?
Yes, Virginia, there is not only a Santa Claus, but there was also not one itty-bitty eensy-teensy bit of collusion between CBS and the Democratic Party on attempting to use criminally forged documents to affect the outcome of a Presidential race!

In mid-august Burkett gave 2 of the documents to CBS. HE WITHHOLDS
THE OTHER 4.
August 21st Burkett memo says he spoke to Max Cleland,
quote "I asked if they wanted to counterattack or ride this to the ground and outlast it, NOT SPENDING ANY MONEY. [ Mr.Cleland] said counterattack. So I gave them the information to do it with."
Did Burkett give CBS two memos but wanted MONEY to relinquish the
other four?
August 25th Cleland is in Texas.
Four days later Burkett posts "We have reassembled" the Bush files.
Sept 4th, Lockhart called Burkett.
Sept. 5th Burkett gave the remaining four documents to CBS. |

My apologies to readers who read this and concluded there was a smoking gun connection between the DNC and CBS. I should have checked what the RNC stated in its timeline.
*sigh* Damn, I'm not as dissimilar to Dan Rather as I thought.
FINAL UPDATE: I spoke to Jano Cabrera, DNC press guy. He politely explained that there was teleconference on Bush's military record, but McAuliffe did not use the phrase "sugarcoated" — and there is a transcript. The "sugarcoated" remark came in an e-mailed statement that was distributed to reporters as the "60 Minutes II" story was beginning, and was based on the posting of the memos on CBS' web site.
