Quote: | “While the members of her family and the members of Congress have acted in a way that is both fervent and sincere, the time has come for dispassionate discharge of duty”, Birch wrote.
He said that “in sum, while Congress may grant jurisdiction to a federal court consistent with Article III” of the Constitution, “it may not assume a function that more properly is entrusted to the judiciary. By arrogating vital judicial functions to itself……Congress violated core constitutional separation principles, it prescribed a ‘rule of decision’ and acted unconstitutionally”. |
Oh my,my!! The Justices are very upset.
Congress can give jurisdiction for the case to the Federal courts,
but how dare they prescribe a de Novo review.
In other words, you can't tell us what to do!
And poor Terri doesn't get a review because the Justices are in a snit!!! _________________ “I love the man that can smile in trouble, that can gather strength from distress, and grow brave by reflection. ‘Tis the business of little minds to shrink; but he whose heart is firm, and whose conscience approves his conduct, will pursue his principles unto death.” (Thomas Paine, 1776) |
