Anyone know how credible an "authority" judicialwatch.org might be?
What are the chances of this going anywhere?

one of the legal eagles should be able to comment on this Navy_Navy_Navy.
It looks like a legit document to me. Whether or not the DOD and Dept of Navy have to act on this is another matter.

Is this true? I sure do hope so. It is about time Kerry is accountable for his actions after the war. While some people might think this is an "old" issue - I do not...and I am not a vet from the Vietnam era. Formal Complaint Filed Over Senator’s Vietnam Awards, Post-Service Activities
(Washington, D.C.) – Judicial Watch, the public interest group that investigates and prosecutes government corruption, today filed a request with the U.S. Navy and the Defense Department for an investigation into the awards granted to Sen. John Kerry during his service with the U.S. Navy in Vietnam. Judicial Watch also requested that military authorities investigate Kerry’s anti-war activities, including his meeting with North Vietnamese and Viet Cong delegations in Paris, while a member of the Naval Reserve.
Basing its requests on a recently published book, Unfit for Command, by former Navy officer John E. O’Neill and Harvard University professor Jerome R. Corsi, and on news media interviews of other officers and sailors who served with Kerry, Judicial Watch notes that unresolved allegations against Kerry include: false official reports and statements; dishonorable conduct; aiding the enemy; dereliction of duty; misuse and abuse of U.S. government equipment and property; war crimes; and multiple violations of U.S. Navy regulations and directives, the Uniform Code of Military Justice and the U.S. Code.
Kerry was awarded three Purple Hearts, a Silver Star and a Bronze Star for “wounds” received and actions in Vietnam, but eyewitnesses refute his version of a number of the events that were the basis for receiving the commendations. Judicial Watch is asking the Department of Defense and the U.S. Navy, including its Department Board of Decorations and Medals, to look into the circumstances surrounding Kerry’s awards.
Judicial Watch also is requesting an investigation of Kerry’s anti-war activities. After he was released from active duty but while he was a commissioned officer in the inactive Naval Reserve, Kerry joined the anti-war group Vietnam Veterans Against the War and traveled to Paris to meet with delegations from North Vietnam and the Communist Viet Cong. He held a press conference in Washington, D.C., following the meeting and advocated the “peace proposal,” which included war damage reparations, put forth by the North Vietnamese and Viet Cong.
“The allegations concerning Kerry’s conduct during the Vietnam War are credible, serious and shocking,” said Judicial Watch President Tom Fitton. “The sooner an investigation begins, the better.” |

They've sued Clinton's people, Bush, and Cheney. I don't think much will come of this, although there might be some press. |

I don't trust Klayman much. He's kind of a gadfly. I wouldn't be surprised if he uses this as a request for funds.
It will be interesting to see how the media cover this though. When he was attacking Clinton he was a right-winger, when he went after Cheney he because a public interest group.

The Kerry campaign has hung their hat on "the Oficial Navy Records" -- his citations and Purple Hearts. Kerryites would have us believe that the facts were all determined 35 years ago and the eyewitness claims made in "Unfit for Duty" are irrelevant.
Now this petition challenges the basis of the Kerry fable. This petition demands that the Navy re-examine ALL of Kerry's awards, IN LIGHT OF NEW EVIDENCE (these affidavits by eye-witnesses).
Now, Kerry can no longer rely on his service record, because his heroism is being officially challenged.
This is a VERY big deal. |

This is good, a request for an investigation (not a law suit) to the Navy and DOD that Lt(jg) Kerry's Awards be revoked is completely proper as it is based on U.S. Law and Navy Regulations: This is used against Officers and Enlisted more often than the public is aware.
1. Title 10 U.S. Code, Section 6249 provides that no medal, cross, bar, or associated emblem or insignia may be awarded or presented to any individual if the service after the distinguishing act or period has not been honorable.
2. Any award for a distinguished act, achievement or service may be revoked before presentation by the approval authority, or after presentation by SECNAV, if facts, subsequently determined, would have prevented the original approval of the award, or if the awardees service after the distinguishing act, achievement or service has not been honorable.
3. If the awardees honorable service is questioned after presentation of the award, forward the entire case to NDBDM via CNO/CMC as appropriate for a determination and final disposition.[/quote]
This is the only way to legally and fairly(assuming our Flag Officers understand their oaths) adjudicate this matter as the court of public opinion can not Revoke his medals or officially prove dishonorable service.
That is what Kerry tried to do with Winter Soldier in '71 and Moore is trying to do with Fahrenheit 911. That's not how I want Kerry to receive his Justice. Regardless, I believe that "Unfit for Command " and the public testimony of these incredible Swift Vets will cause Americans to rationally understand Kerry's Betrayal and Lies.
If his medals are revoked and his service is determined Dishonorable and the American people elect him anyway, then we will know how far we have digressed as a people. But they will live to regret their folly. _________________ __________________________

To me it looks like the whole thing rests on an administrative process vice a legal one. The Navy (under the Bush administration) has the choice of spending resources on a 30+ year old case and getting half of the country upset over what will be called partisan politics. My guess is the Nav will steer clear of this one. I think the jury will have to vote on 2 November. Let's hope they see things our way. |
